Careful handling of your personal data is our highest priority. In processing your data, we comply with the statutory provisions such as the General Data Protection Regulation (GDPR), as well as the relevant national provisions.

This data privacy statement applies to all of our company’s websites accessible under our domain (https://www.ulrichmedical.de/).

As we believe it is important to provide our customers comprehensive information on how we process personal data in our group of companies, you will find an overview below of all our services in which we collect and process personal data.

Where separate or additional conditions may apply to individual services or if we ask you for your consent, we will inform you of this separately prior to your accessing the service (e.g. for newsletter subscription or purchases in our online shop).

In addition, we implement a wide range of security measures to protect your personal data. Therefore, the transmission of data between your web browser and our servers, for example, is always encrypted in transport; in addition, we maintain a variety of technical as well as organizational measures to keep your data protected at all times.

2.      Why we process your data

You can visit our website at any time without disclosing your identity. We will only ask for your name and other personal information if you are subscribing to one of our personalized services, using our online shop or signing up for our newsletter, or if you want to contact us. It is always entirely your own decision whether you supply these (extended) items of data. Any data that we absolutely require in order to provide our services to you will be identified as such.

3.      Types of information about you that we collect and process

We collect different categories of personal data from you. Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name or an identification number. Personal data include information such as your name, your address, your telephone number and your date of birth (if specified). Statistical information, which can be neither directly or indirectly related to you – such as the popularity of individual web pages of our product range or the number of users of a site – is not considered to be personal data. Data can be collected either directly or indirectly. In both cases, only the necessary amount of data is collected; the data is processed exclusively for the purposes listed under item 2. It is entirely your decision whether to send us data which may be useful but not essential for the optimal use of our services. Corresponding data fields are marked as “optional”.

The directly collected data comprise:

  • Title and name, e.g. to personalize your user account or for placing orders in our online shop
  • E-mail address and, where appropriate, a password chosen by you, for example, for the purpose of newsletter subscription, the use of your customer account or for contacting us using the contact form
  • Address data, e.g. for the purpose of order processing (delivery) from our online shop

  • Information relevant to the implementation of our online application procedure

In addition, the following data about you are collected indirectly when using our services:

  • Technical connection data, for example the page of our website visited, your IP address, abbreviated by the last three digits, date and time of the visit, terminal device used
  • Data collected as part of website tracking and newsletter tracking
  • Data that we receive from our service providers as a result of order processing in the online shop, for example, information about the likelihood of payment and payment problems or delivery notifications

Minors:

Our website is not intended for use by minors and we do not knowingly collect personal data from minors.

If persons under 16 years of age provide us with personal information, this is only permitted provided the parent(s) or legal guardian have given their personal consent or have authorized the consent of the minor. For this purpose, according to Article 8(2) GDPR, the contact details of the parent(s) or legal guardian must be communicated to us to demonstrate to us the consent or authorization by the parents or guardian. These data, as well as the data of the minor, are then processed in accordance with this data privacy statement.

If we determine that a minor under the age of 16 has sent personal data to us without the consent of the parent or legal guardian or authorization of consent for the minor, we will immediately delete the data.

4.      Who has access to your data and to whom do we transfer your data?

a) Access

The access to your personal data that we store is restricted to our employees and our appointed service providers, who are required to handle these personal data in the course of their duties.

Third parties may only gain access to your information if we have obtained your prior permission or where there is a legal reason for this.

We also use service providers for the provision of services and for processing your data. Where special provisions apply to these, we have listed these separately for you below for each service. The service providers process data only when instructed by us; they are obliged to comply with the applicable provisions of data protection law. All contract processors have been carefully selected and only obtain access to your data to the extent and for the period of time necessary for the provision of services and within the extent to which you have given your consent for the processing and use of data.

b) Data exchange within the group of companies

Exchange of data within the group of companies to which we belong only takes place for internal administration purposes. Where data is transferred to non-EU countries, this data is safeguarded by appropriate contractual arrangements. We define group of companies to mean affiliated companies within the meaning of Article 4 (19) GDPR.

c) Transfer to non-EU countries and legal basis

The servers of some of the service providers we use are located in the USA and other countries outside the European Union. Companies in these countries are subject to a Data Protection Law which does not generally protect personal data to the same extent as in the member states of the European Union. Where your data is processed in a country which does not have a level of data protection acknowledged to be as high as that of the European Union, we apply contractual provisions or other recognized instruments to ensure that your personal data is adequately protected. We will explicitly inform you of this fact again in the context of the individual services.

To the extent that personal data is transferred to non-EU countries, this takes place on the basis of an adequacy decision of the EU Commission on the EU-U.S. Privacy shield according to Article 45 GDPR or the EU Standard Treaty 2010 according to Article 46(2) (c) GDPR in conjunction with the decision of the EU Commission of 2/5/2010 (2010/87/EU) or according to Article 49 (1) (a) GDPR.

d) Transfer to law enforcement and criminal investigation authorities

In exceptional cases, we forward personal data to law enforcement and criminal investigation authorities. This takes place on the basis of corresponding statutory obligations, arising for example from the criminal procedure code, the tax code, the Money Laundering Act or State Police laws.

5.      Retention periods

We store personal data within the framework of the legal provisions or on the basis of your consent.

To determine the specific retention period, we apply the following criteria:

  • Statutory retention obligations, e.g. under AO (German tax code) and HGB (German trading law)
  • Your consent, for example your consent to or cancellation of a newsletter subscription
  • Duration of a competition and associated prize award
  • Contractual retention requirements, e.g. to display previous orders within a customer account
  • An established contractual relationship, for example latest activity, if no continuing mutual obligation exists
  • Absence of the purpose of the data collection and data storage, for example, termination of a candidate selection process in the context of our electronic application process
  • Technological and forensic requirements, e.g. to protect against attacks and for their tracking

6.      Rights of affected persons

6.1.            Law on access to information and data portability

At any time, you have a right to access personal data about you that we process in accordance with Article 15 GDPR.

If the data processing is based on your consent or on a contract in accordance with Article 6(1) (b) of the GDPR, then under Article 20(1) GDPR, you may demand to obtain the personal data stored about you in a structured, commonly used and machine-readable format, or to have this sent to a system of a third party. Consequently, you have a right to direct forwarding of your data.

6.2.            Right to rectification, restriction and erasure

In addition, in accordance with Articles 16 to 18 GDPR you can demand the rectification, restriction (blocking) or erasure of your personal data (restriction) by us if we have processed the data incorrectly, if a valid reason exists for a restriction of additional data processing, or if the data processing has become unlawful for various reasons, or if their storage is inadmissible for other legal reasons. We should point out that your right to erasure can be restricted by statutory retention periods.

6.3.            Right of objection

Where our data processing is based exclusively on our legitimate interest in accordance with Article 6(1) (f) GDPR, you can submit an objection to this processing under Article 21(1) of the GDPR. We will then suspend processing of your data, unless we can prove defensible grounds for the processing which outweigh your interests, rights and freedoms, or if the processing is used for the enforcement, exercise or defense of a legal entitlement.

6.4.             Right of withdrawal

If you have allowed us to process your personal data by giving your consent, then in accordance with Article 7(3) GDPR you have the right of withdrawal with effect for the future.

6.5.            Right to lodge a complaint with the regulatory authority

You are free to lodge a complaint with a regulatory authority if you think that our processing of your personal data infringes the European General Data Protection Regulations or other national and international data protection laws.

7.      Request for quote via the “360° service”

When you request an individual quotation, we will ask for the following data:

  • Name of the hospital/facility
  • Name of the contact person
  • Address of the hospital/facility
  • Phone number
  • Fax number
  • E-mail address
  • Stamp of the hospital/facility
  • Information on how a service is intended to be used

Data that you provide to us as part of a quotation request will be processed for the purposes of communication and data exchange in accordance with Article 6(1) (a), (b), (c), (f) GDPR. These data are stored for as long as required for processing for the intended purposes or until the expiry of any related retention periods.

8.      Job application documents

You can send job application documents to us by e-mail to application@ulrichmedical.com or by mail. Your application data will be received by the human resources department in charge and will only be forwarded to the department responsible for the particular job or to the persons entrusted with processing it. All parties involved will treat your application documents with the utmost care and in strict confidence. The data are processed in accordance with Article 6(1) (b) GDPR.

After the completion of the candidate selection process, we will
retain your application documents for a further 3 months and then delete them and/or destroy any copies, unless we have concluded an employment agreement with you. If we decide to include your application documents in our applicant pool, we will notify you of this decision. In the notification process, you can actively consent to the further storage of your documents.

9.      Data processing and use of data for external presentation and advertising

9.1.          Cookies and web tracking procedures

9.1.1.    Basic information about cookies and opt-out options

In some areas of our web site, we use so-called cookies, for example, to detect the preferences of our visitors and to enable us to optimize the design of the website. This makes navigation easier and enhances the user-friendliness of a website. We also use cookies to help us to identify particularly popular areas of our website. 9.1.2.    Web Font Services

We use fonts from Monotype Imaging Holdings Inc. to create our website. (hereinafter referred to as the Provider), which are added to our website in the embed code provided by the Provider. In the course of providing the Web Font Services, the Provider places or uses cookies on our website to collect the following information:

  • IP address to count website traffic and prevent misuse of the counter
  • Web Font Project Identification Number (anonymized) and Customer ID identifying us as the license holder and the licensed Web Fonts
  • URL of the licensed web page that is linked to the customer ID

This website uses the WordPress “WP statistics” analysis plugin from Automatic Inc. The provider of this plugin is https://wp-statistics.com.
This tool uses already anonymized data to compile statistics on the general use of our website. To ensure this, no usage profiles of individual visitors are created. All data collected with WP statistics are stored completely anonymously on our own servers. This means any subsequent identification of a specific individual is impossible.

9.1.4.    Youtube video embedding via iFrame in advanced data protection mode

We use Youtube, a service provided by Google, to display video content to you. To protect your privacy, we have enabled the advanced data protection mode.

YouTube also uses cookies to collect information about the visitors to its website. YouTube uses them for purposes such as capturing video statistics, to prevent fraud and to improve user-friendliness. Retrieval of a video usually also leads to a connection being made with the Google DoubleClick network. When you launch the video, this could trigger other data processing operations, especially if you are already logged in to Youtube. We have no influence over this. On our website, we use social media buttons (YouTube, Twitter, XING, LinkedIn) from Twitter Inc., Google Inc., XING AG, Microsoft Corporation (“providers”).

These social media buttons are not integrated as plugins via a so-called iFrame, but are stored as links. By clicking on the social media buttons, you will be taken directly to the site of the corresponding provider. 9.1.6.    DoubleClick by Google

DoubleClick by Google uses cookies to display advertising material that is relevant to you. The software uses a pseudonymous identification number assigned to your browser to monitor which ads have been displayed in your browser and which ones have been viewed. The cookies do not contain any personal information. The use of the DoubleClick cookies allows Google and its partner websites only to link to advertisements based on previous visits to our or other websites on the internet. The information generated by the cookies is transmitted and stored by Google for analysis. Any data transfer by Google to third parties only takes place subject to legal regulations, or in the context of order processing. 9.1.7.    Newsletter

On our website, you have the option to subscribe to our newsletter. This provides you with current product and service information, trade fair and event invitations and other topics relating to the company or its products and services.  It also includes e-mails used for market and opinion research.

To send you the newsletter, we collect and use the e-mail address you supplied at the time of registration subject to your previously granted consent.

The aforementioned marketing e-mails, usually in the form of so-called newsletters, are sent approximately 10–12 times per year and contain information about product and service offerings, invitations to events or other product and service information from the ulrich medical group (ulrich GmbH & Co. If you do not confirm your registration, it will be automatically deleted. Your registration and confirmation are both documented to prevent misuse of your personal data. For this purpose, we store the IP addresses used for your registration, the times of your registration and confirmation and our registration notifications and also the text of your registration and confirmation.

The consenting person has the opportunity to withdraw this consent at any time, free of charge. Simply send an e-mail to the following address: datenschutz@ulrichmedical.com. Alternatively, you can unsubscribe at any time directly in the newsletter sent to you. In case of non-use, the collected data will be stored for a maximum of 2 years or until withdrawal by the consenting person. After this, a new declaration of consent is required.

Newsletter Usage Analysis
Our newsletter contains tracking pixels. A pixel-code is an invisible graphic in HTML e-mails with the purpose of enabling a log file recording and a recording of the links activated from the newsletter with subsequent analysis when the e-mail is opened. This enables us to evaluate the success of our newsletter campaigns by means of statistical evaluations and to optimise our newsletter in order to present you, for example, topics and offers that are better suited to your interests.

The personal data collected in this way will be processed by us. If you do not agree to this, you can unsubscribe from the newsletter at any time free of charge via the link contained therein.

9.1.8.    Use of Google Maps

Our website uses the service “Google Maps” from Google, for example, to provide you with an interactive map, a distributor locator or route planning services.

When starting Google Maps on this website, information is forwarded to Google indicating, for example, that you have visited the corresponding sub-site of our website or else your current location, if you have enabled this function. This takes place regardless of whether Google provides a user account that you are logged into, or whether no user account exists. If you are logged in with Google, your data will be directly associated with your account. 9.1.9.    Use of Google AdWords

Our website uses the service “Google AdWords”, which enables marketers to display advertising in the hit-lists of Google searches and in the Google advertising network. This is based on pre-defined keywords which allow ads only to be displayed in the hit lists if a keyword-based search is performed.

Google AdWords thus enables our website to attract attention by displaying relevant advertising on third-party websites, in the hit-lists of Google searches and also allows the display of relevant third-party advertising within our website.

Each time a user clicks on a corresponding Google ad which links to our website, Google sets a cookie. The cookie can be used both by ourselves and Google to track whether or not you have reached our website via an AdWords ad and whether you generated revenue.

The resulting data is used by Google to compile statistics (e.g. total number of users supplied via Google AdWords, success of our AdWords campaign) for our website. Neither we nor any other advertising customers of Google AdWords receive any information from Google, by means of which you could be identified.

However, the cookies that are set are used to store personal information, for example about the web pages you have visited. Google may sometimes pass this data on to third parties.

The access to your personal data that we store is limited to our employees, and our appointed service providers, who are required to handle these personal data in the course of their duties.
